Business rescue has become commonplace in South Africa and remains a robust and highly creative procedure for rescuing financially distressed companies. With the ever-increasing number of South African financially distressed companies, the ability to give a “failing company” a second chance through the business rescue process has become a refreshing option. When one considers the benefits of business rescue which includes the ability to compromise creditors’ claims, provide for job preservation, and where the practitioner can potentially save the company and allow it to continue trading in the South African economy, it is certainly a mechanism to be taken seriously. Business rescue certainly provides a far better outcome for all stakeholders than were the company to be placed into liquidation.
