<p><strong><em>Embracing the synergy of law and technology: The future of legal practice.</em></strong></p>
<p>The rapid expansion of technology and AI-powered tools is transforming various industries worldwide, leading to a pivotal question within the legal services sector: Will the rise of artificial intelligence, automation, and digitisation make the traditional legal system and the role of legal practitioners obsolete?</p>
<p>While it is evident that artificial intelligence will undoubtedly permeate the legal system and streamline manual processes like discovery and due diligence investigations, rendering the role of legal practitioners obsolete is not a foreseeable outcome, at least not in the near future. The integration of AI-powered tools in document review and legal document preparation does not diminish the importance of legal practitioners’ critical thinking and expertise in evaluating the recommendations generated by AI.</p>
<p>Admittedly, the concept of smart contracts in blockchain technology may appear to eliminate the need for legal practitioners as intermediaries in transactions. These self-executing agreements take effect when specific conditions are met, ensuring speed, efficiency, and accuracy. However, it’s essential to recognize that code is deterministic, meaning a particular input will always produce the same output. This rigidity fails to address the nuanced legal concepts that cannot be easily translated into code. Nevertheless, smart contracts remain valuable for simpler, easily executable agreements.</p>
<p>The emergence of COVID-19 has accelerated the digitisation of legal processes and the adoption of virtual hearings. For instance, the Gauteng High Courts have implemented the CourtOnline system to facilitate the administration of legal proceedings.</p>
<p>As technology and artificial intelligence continue to advance across various industries, certain aspects of legal practice may become automated, enabling legal practitioners to focus more on strategic matters and legal complexities. Law practices will inevitably face pressure to embrace technology and innovation to stay ahead of the curve.</p>
<p>The future of law and technology is one of collaboration rather than replacement. Legal practitioners stand to benefit from leveraging AI-powered tools to enhance their efficiency and effectiveness, ultimately enabling them to provide even greater value to their clients. By embracing this synergy, law firms can navigate the changing landscape and emerge as trailblazers in the legal profession’s evolution.</p>

<p><em><strong>An inside look at the daily life of young lawyers, including work-life balance, networking, and professional growth.</strong></em></p>
<p>As the clock strikes 06:00, my alarm clock jolts me awake, and with it comes a surge of excitement. I drag myself out of bed, shedding away any remnants of grogginess, as I am reminded once more that I am realising my aspirations of becoming a lawyer.</p>
<p>Heading to the office, I kickstart my day with a steaming cup of coffee and a well-organised to-do list. Contrary to popular belief, being a young lawyer doesn’t mean acquiring citizenship in Printerland. While occasional encounters with printers and scanners are inevitable, there is no need to panic about drowning in paperwork. The true learning experience lies in establishing residency within the offices of senior colleagues.</p>
<p>It takes courage to fully immerse oneself in the world of law, but being a young lawyer doesn’t demand wild extroversion. It simply requires the bravery to extend a greeting, ask a question, and express genuine interest, which naturally leads to requests for assistance and engaging debates. It is through these interactions that we, as young lawyers, grasp the practicalities of practicing law.</p>
<p>Driven by my willingness to embrace these opportunities, I am often entrusted with drafting new and challenging tasks. I never hesitate to seek guidance, and I am consistently met with valuable support and mentorship. As a result, I find myself introduced to clients, tasked with proving my worth as a valuable member of the team. I also gather the courage to introduce myself to future senior counsel during visits to counsel’s chambers. With each passing day, I grow both personally and professionally.</p>
<p>When the workday draws to a close, and it’s time to head home, I find solace in playing the cello and indulging in a few episodes (or maybe even four) of Modern Family. I settle down with my diary, reflecting on the events of the day. And amidst it all, I remind myself that although there are still countless achievements awaiting me, the journey itself is a destination worth cherishing.</p>
<p>Continue to join us on Law in Motion as we delve into the fascinating world of young lawyers, witnessing their unwavering determination, the challenges they overcome, and the growth they experience along the way.</p>

<p><em><strong>Trading under the influence – social media, small business and South African law.</strong></em></p>
<p><em>Unleashing the potential of social media for emerging entrepreneurs: Navigating the legal landscape.</em></p>
<p>The remarkable triumph of major corporations in leveraging social media to connect with consumers and promote their brands has sparked a desire among aspiring entrepreneurs to claim their own share of the pie. In this era where social media platforms showcase everything from students selling vintage clothing to influencers selling aspirational lifestyles, having a solid understanding of the legalities surrounding grassroots entrepreneurship has become paramount.</p>
<p>When it comes to selling goods on social media, the Consumer Protection Act No. 68 of 2008 (“CPA”) generally applies, provided that commercial activities occur with sufficient regularity to be regarded as occurring “in the ordinary course of business.” Consequently, the CPA is applicable to the weekly sale of vintage clothing items on Instagram pages, but not to the occasional sale of a used cell phone on platforms like Facebook Marketplace. The CPA encompasses several provisions designed to safeguard consumers and also covers advertising. Pertinent provisions applicable in this context include:</p>
<ol>
<li>Prohibition of misleading marketing: Section 29(b) of the CPA strictly forbids misleading, fraudulent, or deceptive marketing practices. This encompasses activities that mislead consumers regarding a product’s characteristics or benefits.</li>
<li>Implied supplier’s warranty: Sections 55(2) and 56(1) of the CPA establish an implied warranty by the supplier that goods are of good quality, reasonably fit for their intended purpose, and usable for a reasonable period of time.</li>
</ol>
<p>Concurrently with the CPA, the consumer protection provisions of the Electronic Communications and Transactions Act No. 25 of 2002 (“ECTA”) come into effect when products are bought and sold on social media. Under section 44 of ECTA, consumers generally have a seven-day window from the receipt of a product to cancel a transaction. Additionally, section 46 of ECTA stipulates that orders must be fulfilled within 30 days unless otherwise agreed. Failure to adhere to this timeline enables the consumer to cancel the transaction with seven days’ written notice.</p>
<p>Moreover, if the goods being sold qualify as second-hand goods, as defined in the Second-Hand Goods Act No. 6 of 2009, the dealer may need to register in accordance with section 2(1) of the Act.</p>
<p>In order to maintain ethical practices in the realm of social media, the Advertising Regulatory Board’s <em>Code of Advertising Practice</em> includes the Social Media Code, which offers guidance to “brands, publishers, and influencers.” It emphasises the importance of transparency and disclosure. Advertisers should clearly indicate if their content is part of a social media advertising campaign, whilst publishers and influencers should disclose any goods or services they have received in exchange for media coverage. Influencers making claims about goods and services should adhere to the standards set forth in the Code, and the defence of fair comment is not considered valid if false claims are made.</p>
<p>Undoubtedly, social media has played a pivotal role in democratising entrepreneurship. It is evident that a comprehensive understanding of consumer law serves as a crucial tool for young South Africans seeking to grow their businesses fairly and sustainably using social media platforms.</p>

<p>In today’s rapidly changing world, the legal profession is continuously evolving to adapt to economic, cultural, and political trends. It is crucial for lawyers who want to remain responsive to their clients’ ever-changing legal needs, as well as for students considering a career in law, to stay informed about the following three legal trends that are currently shaping the industry.</p>
<ol>
<li><strong>Emphasis on sustainability and renewable energy.</strong><br />
Climate change and sustainability have become global priorities, prompting many businesses to shift towards renewable energy projects and move away from traditional power grids, especially due to the severity of loadshedding. To stay relevant, it is advisable for aspiring lawyers to expand their knowledge in fields such as environmental law, climate change and sustainability, carbon trading, and renewable energy. In South Africa’s current climate, expertise in these areas can create significant opportunities for young lawyers looking to grow their practice.</li>
<li><strong>Artificial Intelligence (AI) and technology law.</strong><br />
The emergence of large language models (LLMs) like ChatGPT has generated excitement about how artificial intelligence (AI) will impact society and the economy as a whole. However, experts have raised concerns regarding the potential effects of LLMs on privacy and intellectual property. The legal field is also experiencing significant transformation as generative LLMs continue to evolve. The COVID-19 pandemic has already accelerated the digitization of our courts. Therefore, it is essential for law graduates to acquire knowledge in fields such as information technology, data privacy, intellectual property, and the ethics of AI. These areas will become increasingly important in the coming decades.</li>
<li><strong>The ‘Metaverse’, NFTs and cryptocurrency.</strong><br />
Technological innovations have given rise to exciting new concepts. The ‘Metaverse’ refers to a three-dimensional digital space that utilises virtual and augmented reality technologies. Meta, formerly known as Facebook, is a key player in this field. In the Metaverse, users can purchase content using real money or non-fungible tokens (NFTs). NFTs are unique digital assets assigned a distinct identifier through blockchain technology. They can represent digital art, files, music, and more. NFTs can be acquired using cryptocurrency or traditional currency. Cryptocurrency, a digital or virtual currency secured through cryptography and blockchain technology, is decentralized and not governed by a central authority, such as a reserve bank. Currently, these concepts are not widely understood, and regulations surrounding them are limited. Similar to LLMs and ChatGPT, having experience and knowledge in these areas may become increasingly valuable in the years to come as their true potential is uncovered and lawmakers recognize the need for appropriate regulation.</li>
</ol>
<p>By staying abreast of these legal trends, law graduates can position themselves for success in an ever-evolving industry. The ability to adapt and specialise in these emerging fields will enable them to better serve their clients and contribute to the advancement of the legal profession as a whole.</p>

</strong>Immerse yourself in the world of words – as a lawyer, you will find yourself constantly reading and witing as part of your professional life, therefore the ability to effectively communicate through the written word is paramount. You will draft emails, letters, court papers, reports and opinions and cultivating these skills early on will help you prepare for what lies ahead. Approach each assignment with utmost diligence. Start exercising this muscle through making a habit of reading legal journals, law reports and pursuing writing recreationally on topics that interest you.</li>
