What is Regulatory Law?
Businesses worldwide are facing increasingly complex forms of regulation, accompanied by increased risk profiles, as result of more state-regulators being empowered to not only conduct investigations, but also impose sanctions on entities/bodies who fall foul of the relevant regulatory regime. Accordingly, regulatory compliance issues are now part of everyday life for most businesses; and matters of non-compliance have come to the fore insofar as reputational and/ or financial risks for businesses are concerned.
Regulatory frameworks are constantly evolving, and such evolution has brought about increased pressure on businesses to take proactive steps to adapt their corporate governance (and other related structures) in a manner that ensures compliance with regulatory frameworks. Accordingly, the ability to provide appropriate counsel – be it from a domestic or international perspective – has become all the more important.
South Africa’s Regulatory Landscape
Regulatory Law goes beyond traditional enforcement and/or prosecution proceedings (be it from a civil or criminal perspective). This is because regulatory matters are notoriously complex as a result of the broad and diverse manner in which various regulatory frameworks may apply to a single entity/person.
